GENERAL TERMS AND CONDITIONS OF BUSINESS

1. General

The following terms apply for all events, courses and services by FAIR BOSS FEELING, except different conditions are defined in a written agreement. The participant agrees on the General Terms and Conditions of Business by enrolment to an event or by commission of a service. We reserve for ourselves the right to cancel events and courses because of for example illness of the team (human and horse) and if the minimum number of participants is not achieved. Changes that do not change the overall character of the event do not allow the participant’s cancellation of the contract or a decrease of the invoice amount. The place can be changed within an appropriate distance.

2. Enrolment

Enrolments have to be submitted in writing either by Email or by mail. They are worked on in their order of receipt. Application dates are stored electronically for intern purposes only in compliance with the data privacy act. An invoice will be send in advance.

3. Payment conditions

The participation fee is due immediately after invoicing, but not later than four weeks in advance of the date of event. In case of delayed payment we reserve the right to give the participant’s course slot to another participant.
The invoiced participation fee usually includes the event, the described boarding during the course, possible course documents and accommodations, except different conditions are defined in the course description.

4. Cancellation

Cancellations must be always made in writing. FAIR BOSS FEELING refunds 100% of the participation fee in the case of a cancellation 6 weeks before the date of event, 50 % of the participation fee in the case of a cancellation four weeks before the date of event, 25% of the participation fee in the case of a cancellation two weeks before the date of event. In the case of cancellation after this period or non-participation the full invoice amount has to be paid. An appropriate substitute participant can be named. If a participant does not use all services of an event, there is no claim for refund.
FAIR BOSS FEELING reserves the right to cancel the event if force majeure prevents a regular realisation of the event. The same applies if the minimum number of participants is not reached.

If an event is cancelled by FAIR BOSS FEELING, the participants are given a selection of alternate dates. Alternatively, FAIR BOSS FEELING refunds the participation fee already paid to 100%.

The invoiced participation fees include exclusively the event, the described boarding during the course and possible course documents. The participants’ and trainers’ accommodation and travel costs are not included, except different conditions are explicitly defined in the course description.

The employer or the participants have to ensure for their accommodation during the course times. FAIR BOSS FEELING can book accommodations on behalf of the employer or the participants if they express this wish explicitly. In the case of cancellation the employer or the participants have to pay for the accommodation reservation.

5. Responsibility

Participation to all events is at one’s own risk. Participants are responsible for damages they cause. FAIR BOSS FEELING is only responsible for wilful and reckless behaviour. Responsibility on account of culpably caused damage to life, body or health remains unaffected.
FAIR BOSS FEELING as service contractor is responsible within the framework of legal liability for other damages in the maximum case at height of the participation fee already paid. This also applies to a short-term cancellation of an event, if this is because of illness of the trainers, illness of the horses or force majeure. The responsibility for force majeure, third party damages and any kind of compensation is excluded.

6. Final Clauses

If any clause of the General Terms and Conditions of Business or any clause in another further written agreement proves invalid or becomes so in the future, the validity of these terms and conditions or the agreement as a whole shall not thereby be affected.

An in full or in part invalid or incomplete clause will be replaced with a clause that comes as close as possible in a legally permitted manner to that which was previously intended by the parties. Any agreements if different from the existing General Terms and Conditions of Business require the written form for their validity. German law shall apply exclusively.
